I. General terms

    Regulations - these regulations
    Service - the Internet service "Viperys.com", operating under the address viperys.com
    Service Provider - "Sebastian Żmijewski" company with registered office address: 86-300 Grudziądz, Dąbrówki 9, NIP: 8762366034,
    Customer - any natural person accessing the Site and using services provided by means of the Site by the Service Provider.
    Electronic Communication - communication between the parties via electronic mail (e-mail) and contact forms available on the website.

II. General provisions

    These Terms and Conditions govern the functioning and use of the Site and specify the rights and obligations of Clients and Service Provider related to the use of the Site.
    The object of the Service Provider's services is to make available, free of charge, tools in the form of the Site, which enable Clients to access content in the form of posts, articles and audiovisual materials, or web applications and electronic forms.
    Any content, articles and information containing tips or advice published on the Site is only a general set of information and is not addressed to individual customers. The service provider is not responsible for their use by the recipients.
    The recipient takes full responsibility for the use of materials available on the Site, including use in accordance with applicable law.
    The service provider makes no warranty as to the suitability of the materials posted on the site.
    Service Provider shall not be liable for any damages incurred by Clients or third parties in connection with the use of the Site. Any risk related to the use of the Site, and in particular to the use and application of information posted on the Site, shall be borne by the Client using the Site.

III. Terms and conditions of using the Site

    The use of the Site by each Client is free of charge and voluntary.
    Clients are required to read the Terms and Conditions and other documents forming an integral part thereof, and must accept their entirety in order to continue using the Site.
    Recipients may not use any personal information obtained on the Site for marketing purposes.
    Technical requirements for using the Site:
        a device with a display capable of displaying web pages,
        Internet connection,
        any web browser that displays websites in accordance with the standards and provisions of the W3C Consortium and supports websites made available in HTML5,
        JavaScript support enabled,
        cookies are enabled
    To ensure the safety of the Service Provider, the Client and other Clients using the Site, all Clients using the Site shall comply with generally accepted network security principles,
    Activities performed by recipients personally or through the use of software are prohibited:
        without written permission, decompiling and analyzing the source code,
        without written permission, causing excessive load on the server Service,
        without written permission, attempts to detect vulnerabilities in the security of the Site and the server configuration,
        attempt to upload or inject code, scripts and software, which may harm the software of the Site, other Clients or the Service Provider, into the server and the database
        attempt to upload or input any code, scripts or software to the server or database that may track or steal Client or Service Provider data
        take any action to damage or disable the Service or to defeat the purpose of the Service.
    If a Cyber Security incident or a breach of the RODO is detected or has the potential to occur, Service Recipients should first report this to Service Provider in order to quickly remedy the problem/threat and safeguard the interests of all Service Recipients of the Service.

IV. Conditions and rules for registration

    Clients can use the Site without registration.
    Clients must be registered and have an account on the Site in order to use additional services provided by the Site, available only to Clients after logging in.
    Registration on the Site is voluntary.
    Registration on the Site is free of charge.
    Each Client may have only one account on the Site.
    Technical requirements for account registration:
        having an individual e-mail account,
    By registering on the Site, Clients consent to the processing of their personal data by the Service Provider to the extent to which they were entered into the Site during the registration process, as well as their subsequent modification or deletion.
    The Service Provider has the right to suspend or delete Clients' accounts at its sole discretion, preventing or restricting access to particular or all services, content, materials and resources of the Site, in particular if the Client has violated these Terms and Conditions, generally applicable laws, rules of social conduct or acts to the detriment of the Service Provider or other Clients, the legitimate interests of the Service Provider and third parties cooperating or not with the Service Provider.
    All services of the Site may be changed in terms of their content and scope, added or subtracted, as well as temporarily suspended or restricted, at the discretion of the Service Provider, without the possibility of objection in this regard by the Client.
    Additional security rules for account use:
        Service Recipients registered on the Site are prohibited from sharing the login and password for their account with any third party.
        The Service Provider does not have the right and will never request the password for a selected account from a Service Recipient.
    Deletion of an account:
        Each Service Recipient with an account on the Site has the option to delete the account from the Site on their own.
        Recipients can do this after logging into the panel on the Site.
        Deletion of the account results in the deletion of any identifying information and anonymization of user name and e-mail address.

V. Terms and conditions of Newsletter service

    Customers may use the Site without subscribing to the Newsletter.
    Signing up for the Newsletter service is voluntary.
    Signing up for the Newsletter service is free of charge.
    Technical requirements related to the Newsletter service:
        having an individual e-mail account,
    Conditions for Newsletter service provision:
        providing individual e-mail account in the electronic form,
        verification of the provided e-mail account by activating the link sent to it,
        expressing consent to receive e-mail notifications,
    Newsletter service scope:
        notification of new news, posts, contests, and other promotional actions related to the services of the Site,
        notification of promotional activities of Site partners (marketing messages),
    unsubscribe from the Newsletter service:
        Each Customer subscribed to the Newsletter service has the opportunity to unsubscribe from the Service on their own.
        Service Recipients may do so through a link included in each email message sent.
        Unsubscribing from Newsletter service shall result in removing the email address from the Newsletter database.

VI. Terms and conditions of communication and provision of other services on the Site

    The Site provides services and tools enabling Clients to interact with the Site, such as:
        Contact form
        Commenting on posts and articles
    The Website provides contact details in the form of:
        E-mail address
    In the case of contact between the Client and the Service Provider, the Client's personal data shall be processed in accordance with the Privacy Policy, which forms an integral part of the Terms and Conditions.
    Conditions for posting content by Clients on the Site:
        You may not post content on the Site that is abusive or defamatory towards the Service Provider, other Service Recipients, third parties or third parties,
        The following material may not be posted on the Site: text, graphics, audiovisual, scripts, software and other works, which are not licensed by the Client or whose author has not agreed to free publication,
        It is prohibited to place on the Site vulgar, pornographic, erotic and inconsistent with Polish and European law content, as well as links to sites containing such content,
        It is forbidden to place in the Service scripts and programs that excessively load the server, illegal software, software used to violate security and other similar activities, as well as links to sites containing such materials,


        It is forbidden to place in the Service content marketing and advertising other commercial services, products, services or commercial websites.

VII. Collection of data about Clients

In order to properly provide the services of the Site, to protect the Service Provider's legal interests and to ensure compliance of the Site with applicable laws, the Service Provider collects and processes certain data on Users through the Site.

In order to properly provide services, the Site uses and saves certain anonymous information about the Client in cookies.

The scope, purposes, manner and principles of data processing are available in the appendices to the Regulations: "RODO Information Obligation" and the "Privacy Policy", which form an integral part of the Regulations.

    Data collected automatically:
    For the smooth operation of the Website and for statistics, we automatically collect certain data about the Service Recipient. These data include:

        Screen resolution
        Approximate location
        Subpages opened on the website
        Time spent on relevant subpage
        Operating system type
        Previous subpage address
        Referring website address
        Browser language
        Internet connection speed
        Internet Service Provider
        Anonymous demographic information based on Google Analytics data:
            Gender
            Age
            Interests
        Anonymous data needed to serve ads:
            Data related to remarketing
            Data related to the reporting of displayed advertisements

    The above data is obtained through the Google Analytics script and is anonymous.
    Data collected during registration:
    User name, first and last name, email address

    In the case of Clients who are logged in (have an account on the Website), cookies stored on the Client's device may include the Client's identifier linked to the Client's account
    Data collected when subscribing to the newsletter:
    e-mail address

VIII. Copyright

    The Service Provider is the owner of the Site and copyrights.
    Part of the data posted on the Site is protected by copyright belonging to companies, institutions and third parties, not related in any way to the Service Provider, and is used under the obtained licences or based on a free licence.
    Pursuant to the Act of February 4, 1994 on Copyright, it is prohibited to use, copy, reproduce in any form and store in search systems, except for the search engines Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook and LinkedIn any articles, descriptions, photos and any other content, graphic, video or audio material found on the Site without the written consent or permission of their legal owner communicated through Electronic Communications.
    Pursuant to the Act of 4 February 1994 on Copyright, simple press releases, understood as information itself, without commentary or evaluation by the author, are not protected. The author understands this to mean that he is free to use the information from the published texts, but not to copy the entire article or parts of it, as long as this is not explicitly stated in the material on the website.

X. Postanowienia końcowe

    Usługodawca nie odpowiada w żaden sposób, jak tylko pozwalają na to obowiązujące przepisy prawa, za treści przekazywane i publikowane w Serwisie przez Usługobiorców, za ich prawdziwość, rzetelność, autentyczność czy wady prawne.
    Usługodawca dokona wszelkich starań by usługi Serwisu były oferowane w sposób ciągły. Nie ponosi on jednak żadnej odpowiedzialności za zakłócenia spowodowane siłą wyższą lub niedozwoloną ingerencją Usługobiorców, osób trzecich czy działalnością zewnętrznych automatycznych programów.
    Usługodawca zastrzega sobie prawo do zmiany jakichkolwiek informacji umieszczonych w Serwisie w wybranym przez Usługodawcę terminie, bez konieczności uprzedniego powiadomienia Usługobiorców korzystających z usług Serwisu.
    Usługodawca zastrzega sobie prawo do czasowego, całkowitego lub częściowego wyłączenia Serwisu w celu jego ulepszenia, dodawania usług lub przeprowadzania konserwacji, bez wcześniejszego uprzedzania o tym Usługobiorców.
    Usługodawca zastrzega sobie prawo do wyłączenia Serwisu na stałe, bez wcześniejszego uprzedzania o tym Usługobiorców.
    Usługodawca zastrzega sobie prawo do dokonania cesji w części lub w całości wszelkich swoich praw i obowiązków związanych z Serwisem, bez zgody i możliwości wyrażania jakichkolwiek sprzeciwów przez Usługobiorców.

IX. Amendments to the Terms of Service

    All provisions of these Terms and Conditions may be unilaterally amended by the Service Provider at any time, without giving reasons.
    Information on amendments to the Terms and Conditions shall be sent electronically to Clients registered on the Site.
    In the case of amendments to the Terms and Conditions, their provisions shall enter into force immediately upon their publication for Clients who do not have a Site account.
    In the case of amendments to the Terms and Conditions, their provisions shall enter into force with a 7-day transition period for Clients with Service accounts registered before the amendment of the Terms and Conditions.
    Each Client continuing to use the Site after the modification of the Terms and Conditions shall be deemed to have accepted them in full.
